This document presents the Conditions for Access (“Conditions for Access”) which constitutes a binding legal agreement between you and NectarLab, LLC, operating as NectarLab (“NectarLab,” “our team,” “us,” or “our entity”). It outlines the regulations for utilizing the NectarLab website and other associated NectarLab services (jointly referred to as the “Platform”) and the acquisition and usage of products and services offered via the Platform. By engaging with the Platform via any device such as computers, smartphones, tablets, gaming consoles, etc., you acknowledge, comprehend, and consent to abide by these Conditions for Access, irrespective of your registered status on the Platform. We reserve the right to modify these Conditions for Access at our discretion. We will announce any amendments in the Platform’s footer, with such amendments becoming effective 30 days post-announcement. Continual use of the Platform implies your acceptance of the amended Conditions for Access. If you disagree with these Conditions for Access, you are advised not to use the Platform.

We advise consulting a certified health professional before using herbal products, especially if you are expecting, nursing, or on medication.

Your personal information and content usage is subject to our Privacy Policy, which is incorporated into this document by reference.

PROTECT YOUR LOGIN DETAILS

You are accountable for any activity under your NectarLab account. Safeguard your login credentials and prevent others from using them to access the Platform. NectarLab cannot be held liable for losses stemming from unauthorized use of your account, whether you are aware of it or not.

COPYRIGHTS AND INTELLECTUAL PROPERTY

All materials on the Platform, including texts, images, designs, logos, literature, icons, presentations, videos, data, instructions, photos, and software (collectively, the “Content”) are owned by NectarLab or its content providers. This Content is protected under copyright, trademark, and other intellectual property laws.

Our trademarks, service marks, and logos, and those of third parties on the Platform are the property of their respective owners. Unauthorized use of these trademarks is strictly prohibited without written consent from NectarLab or the trademark owners.

LIMITED USAGE LICENSE

Provided you adhere to these Conditions for Access, you are permitted to access the Platform and use the Content for personal, non-commercial purposes or for ordering products from the Platform. Any commercial use of the Content, including distribution, publication, or personal financial gain, is strictly forbidden.

PLATFORM USAGE RESTRICTIONS

You agree to use the Platform in compliance with all applicable laws and regulations, and in accordance with these Conditions for Access. Without explicit permission from NectarLab, you are prohibited from:

• Using automated means to collect information from the Platform;
  Modifying, distributing, or commercially exploiting the Content;
  Creating site mirrors or using framing techniques without authorization;
  Bypassing technical limitations of the Platform or reverse engineering it;
  Interfering with the Platform’s functioning or impeding other users’ access;
  Altering or removing proprietary notices on the Content;
  Misrepresenting your identity or unauthorized use of another’s account;
  Using hidden texts with NectarLab’s trademarks in any online site;
  Collecting user information or engaging in unauthorized commercial activities;
  Creating databases with downloaded Content;
  Posting inappropriate or objectionable material.

USER-GENERATED CONTENT

Your contributions to the Platform, including reviews, comments, endorsements, testimonials, pictures, videos, and other forms of content, grant NectarLab a non-exclusive, perpetual, worldwide, royalty-free, and transferable license to use, copy, distribute, display, modify, create derivative works, and commercialize such content in any known or future media, without compensation to you. You acknowledge this content is not confidential.

Should you offer creative suggestions, proposals, or ideas about our products and services, these will be deemed non-confidential and become our sole property, without any obligation for compensation or acknowledgment.

CONTENT STANDARDS

You warrant that your content and activities on the Platform do not violate these Conditions for Access or any third-party rights, including intellectual property and publicity rights. You are solely responsible for your content and activities on the Platform.

USER CONTENT MONITORING

We do not prescreen user content and cannot guarantee the accuracy or appropriateness of such content. We act as a passive channel for distribution and bear no liability related to user content or activities. We reserve the right, however, to monitor and remove user content at our discretion.

LINKING POLICY

Links to our homepage are permitted if done fairly and without harming our reputation. However, no endorsement, association, or approval from us is implied without our express consent.

ACCOUNT TERMINATION

We may, at our discretion, terminate accounts, delete content, restrict Platform use, or modify or discontinue the Platform or parts of it. We may also use technology to prevent certain users from accessing or posting content.

CREDIT CARD INFORMATION STORAGE AND SECURITY

By utilizing the Platform, you acknowledge and consent to NectarLab’s storage and use of your credit card information. NectarLab adheres to stringent data protection and security protocols to ensure the confidentiality and safety of your credit card information.

  Compliance with Payment Card Industry Data Security Standard (PCI DSS): NectarLab is fully compliant with the requirements of the PCI DSS. This compliance ensures that all credit card information is handled in a secure environment.
   
  Limited Access: Access to stored credit card information is restricted to authorized personnel only, who require such access to process transactions or maintain the Platform.
   
  Regular Audits and Monitoring: NectarLab conducts regular audits and continuous monitoring to ensure the ongoing security of credit card information.

User Responsibilities and Acknowledgements

• Accuracy of Information: You are responsible for providing accurate and current credit card information. NectarLab is not liable for errors or issues arising from incorrect information supplied by the user.
   
  Notification of Unauthorized Use: You must promptly notify NectarLab of any unauthorized use or suspected breach of your credit card information.
   
  Consent to Store Information: By providing your credit card information, you expressly consent to its storage and use as outlined in these Conditions for Access.

Liability and Indemnification

• Limitation of Liability: NectarLab’s liability concerning the storage and use of credit card information is limited to the extent permitted by law. NectarLab is not liable for any unauthorized access that is beyond its reasonable control.
   
  User Indemnification: You agree to indemnify and hold harmless NectarLab, its affiliates, and agents from any claim, loss, or damage arising from your breach of this section or unauthorized use of your credit card information.

Updates to Credit Card Information Storage Policy

NectarLab reserves the right to modify its credit card information storage and security practices. Any changes will be communicated through the Platform and will take effect as specified in the notice of such changes.

REPRESENTATIONS AND WARRANTIES

You affirm that: (i) you meet the legal age requirements; (ii) your information is accurate; (iii) you have the right and authority to agree to these Conditions for Access; (iv) you will adhere to all laws, including tax laws; (v) your use of the Platform is lawful; and (vi) your Platform usage complies with these Conditions for Access.

WARRANTY DISCLAIMERS

The Platform and its products or services are provided “as is.” We disclaim all warranties, express, implied, or statutory, including those of quality, performance, merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted, secure, or error-free service. We are not responsible for any damages resulting from your use of the Platform.

LIMITATION OF LIABILITY

NectarLab and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform or its products or services. Some jurisdictions do not allow certain liability limitations, so these may not apply to you.

INDEMNIFICATION

You agree to defend and indemnify NectarLab against any claims or expenses arising from your violation of these Conditions for Access or your Platform use.

ELECTRONIC COMMUNICATIONS

By using the Platform, you consent to receive electronic communications from us. You can unsubscribe at any time. All communications will comply with legal requirements.

THIRD-PARTY SITES

The Platform may include links to Third-Party Sites, over which we have no control. We are not responsible for the content or policies of these sites.

MISCELLANEOUS PROVISIONS

• Survival: Certain terms will survive the termination of these Conditions for Access.
  Assignment: These Conditions for Access are non-transferable by you but may be assigned by NectarLab.
  Disputes: Governed by the laws of Florida, with jurisdiction in Collier County.
  Claim Limitations: Claims must be filed within one year.
  No Waiver: Failure to enforce any rights does not constitute a waiver.
  Severability: If any provision is invalid, others remain in effect.
  Entire Agreement: These Conditions for Access and our Privacy Policy constitute the entire agreement between us.
